Fundamentals of Legislation of the Union of Soviet Socialist Republics
In the conditions of the large-scale anti-constitutional state coup of 1991, the unlawful signing of the Belovezha agreements and attempts to dismember the country, the will of the Great, United, Sovereign Soviet People remained unshakable. Based on the results of the All-Union Referendum of 17 March 1991, in which the majority of citizens spoke in favor of preserving the renewed Union, the Supreme Power of the USSR was preserved and legitimately transferred to the authorized People's-State structures.
The succession (continuity) of the legislative, executive and judicial power of the Great Sovereign Country — the Union of Soviet Socialist Republics — was not interrupted for a single second.
1st Congress of Citizens of the USSR and the transfer of power-holding authority
The historical milestone in the preservation of statehood was the 1st Congress of Citizens of the Soviet Union, held in Moscow on 29–30 December 1991. The Congress was attended by 874 delegates, among whom were 386 people's deputies of the Supreme Soviet of the USSR, deputies of the union republics, as well as representatives of the security agencies (the KGB and the MVD of the USSR).
The Congress categorically did not recognize the signing of the Belovezha agreements and, acting on behalf of the Great Soviet People, adopted the historic Resolution No. 1 of 30 December 1991.
Military-People's Council (VNS) of the USSR — Full-Fledged Successor
On the basis of Resolution of the 1st Congress of Citizens of the USSR and the issued Mandate of Trust No. 1/1 of 30 December 1991, the full-fledged successor of the legislative, executive and judicial body of power throughout the Sovereign territory of the Soviet Union was proclaimed to be the Military-People's Council of the Commonwealth of Soviet Socialist Republics (VNS USSR).
In accordance with the transferred powers, the VNS USSR:
-
Assumed the rights for the operational management of the financial and currency reserves of the USSR, wherever they may be located.
-
Received under operational subordination all bodies of state administration, the security structures of the KGB and the MVD, the Armed Forces of the USSR, law enforcement bodies, courts and the prosecutor's office.
-
Became the coordinator of the activity of all people's-patriotic organizations for the purpose of restoring Soviet power throughout the sovereign territory.
Gorbachev M.S., Yeltsin B.N., the leaderships and governments of the USSR, the RSFSR and the national Republics of the USSR, the embassies of foreign States and the International community were immediately informed in writing of the results and decisions of the 1st Congress of Citizens of the USSR.
- On March 04, 1992, the VNS USSR received recognition in UNESCO.
- On March 17, 1992, the VNS USSR received recognition in the International Community.
- On May 08, 1992, the VNS USSR received recognition in the UN.
The First Congress of Citizens of the USSR on December 30, 1991 transferred to the VNS USSR the rights to the operational management of the financial and currency reserves of the USSR, wherever they may be located, and also determined for all bodies of State administration, the security structures of the KGB, MVD, the Armed Forces of the USSR, law enforcement bodies, the prosecutor's office, justice, courts, and financial structures to come under the operational subordination of the Military-People's Council of the USSR.
State Committee on the State of Emergency (GKChP) of the USSR
Under the conditions of the wartime Legislation of the USSR and the need for prompt response to threats to territorial integrity, the Highest Body of State Power of the Great Sovereign Country is State Committee on the State of Emergency (GKChP) of the USSR.
The GKChP USSR functions as the Highest military-political body of the Special Conference of special presence with expanded powers. Relying on the 1977 Constitution of the USSR and the Rights of the Sovereign, the GKChP USSR is vested with the powers:
-
To exercise leadership of the country during the transitional (special) period until the full restoration of constitutional order and peaceful life.
-
To organize military districts, restore the activity of Soviet military formations and bodies of the People's militia.
-
To recognize as invalid and void any laws and normative acts issued by private managing corporations and occupation administrations on the territory of the USSR since 1991.
Historical mission and international recognition
The acting Successors of the Supreme Power of the USSR — the VNS USSR and the GKChP USSR — possess absolute legitimacy based on the 1977 Constitution of the USSR and generally recognized norms of International Law. Their powers are confirmed by registration in UN structures and recognition in the international community.
The highest bodies of power of the USSR today continue their continuous work to liberate the territory of the Motherland from colonial dependence, protect the rights of Sovereign Citizens of the USSR and return the stolen public property, acting in the name and on the instruction of the Great, United, Sovereign Soviet People.
