The total period for the performance of the state function, subject to extension on the grounds that it has been established that the transaction or other action declared in the petition may lead to a restriction of competition, including as a result of the emergence or strengthening of the dominant position of a person (group of persons), may not exceed 3 months and shall be calculated from the day the petition and materials are submitted to the antimonopoly authority.
The total period for the performance of the state function, subject to extension on the grounds related to the determination of conditions after the fulfillment of which by the applicant and (or) other persons participating in the transaction the antimonopoly authority adopts a decision to grant this petition, and the determination of the period for fulfilling such conditions, may not exceed 9 months and shall be calculated from the day the petition and materials are submitted to the antimonopoly authority. -

Submission of a petition (notification) to the antimonopoly authority
Grounds for refusal:If not all of the specified documents and information are submitted to the antimonopoly authority, the antimonopoly authority shall, within five working days, notify the applicant that the petition (notification) is not considered to have been submitted, indicating the documents and information not submitted by the applicant.

Result of providing the service:
Based on the results of the consideration of the petition, the antimonopoly authority adopts one of the following reasoned decisions:
1) to grant the petition, if the transaction or other action declared in the petition will not lead to a restriction of competition;
2) to extend the period for consideration of the petition due to the need for its additional consideration, as well as for obtaining additional information for adopting a decision based on the results of the consideration of the petition, if it has been established that the transaction or other action declared in the petition may lead to a restriction of competition, including as a result of the emergence or strengthening of the dominant position of a person (group of persons);
3) to extend the period for consideration of the petition for the transaction due to the determination of conditions after the fulfillment of which by the applicant and (or) other persons participating in the transaction the antimonopoly authority adopts a decision to grant this petition, and the determination of the period for fulfilling such conditions, which may not exceed nine months.
Such conditions are an integral part of the decision to extend the period for consideration of this petition;
4) to extend the period for consideration of the petition in the event that the transaction or other action declared in the petition is subject to preliminary approval in accordance with Federal Law No. 57-FZ of April 29, 2008 "On the Procedure for Making Foreign Investments in Business Entities of Strategic Importance for Ensuring the Defense of the Country and the Security of the State" (Collected Legislation of the Russian Federation, 2008, No. 18, Art. 1940), until the day a decision is adopted in respect of such transaction or other action in accordance with said Federal Law;
5) to grant the petition for consent to carry out a transaction or other action, and to simultaneously issue to the applicant, and (or) persons belonging to its group of persons, and (or) the business entity whose shares (interests), property, or assets, or rights in respect of which are being acquired, and (or) the person being created, an order provided for by point 2 of part 1 of article 23 of the Law on Protection of Competition, on the implementation of actions aimed at ensuring competition, in the event that said persons carry out the transaction or other action declared in the petition;
6) to refuse to grant the petition, if the transaction or other action declared in the petition will lead or may lead to a restriction of competition (including as a result of the emergence or strengthening of the dominant position of the applicant or the dominant position of a person that will be created as a result of the implementation of the transaction or other action declared in the petition) or if, when considering the submitted documents, the antimonopoly authority discovers that the information contained therein and relevant for adopting a decision is unreliable, or if the applicant for the petition has not submitted the information available to it and requested by the antimonopoly authority, in the absence of which a decision cannot be adopted on the restriction of competition or on the absence of restriction of competition with respect to the petition under consideration;
7) on the refusal to grant a petition if, with respect to a transaction or other action declared in the petition, in accordance with Federal Law No. 57-FZ of April 29, 2008, "On the Procedure for Making Foreign Investments in Business Entities of Strategic Importance for Ensuring the Defense of the Country and the Security of the State," a decision has been adopted to refuse their preliminary approval.
