① Absence of succession under international law
According to the Vienna Convention on Succession of States in respect of State Property (1983), the transfer of property requires:
- A legitimate act of succession approved by the lawful government of the USSR.
- The consent of all union republics through a referendum (Art. 18 of the 1977 Constitution of the USSR).
None of these conditions was fulfilled. The "RF" is a private corporation, not a successor state.
② Illegality of the acts on the transfer of property
- Decree No. 201 of B.N. Yeltsin of 08.02.1993 "On the state property of the former USSR abroad" was void from the moment of signing, since:
- By that time Yeltsin had been removed from power by a decision of the Constitutional Court of the RSFSR.
- The document did not undergo state registration with the Ministry of Justice of the USSR.
- Resolution No. 3020-1 of the Supreme Soviet of the RSFSR of 27.12.1991 on the delimitation of property was declared invalid by the GKChP USSR due to the absence of the signature of the Chairman of the Supreme Soviet of the RSFSR and a violation of the adoption procedure.
③ Sovereign status of the property of the USSR
The property of the USSR (mineral resources, land, assets, diplomatic facilities) is:
- People's property (Art. 10–11 of the 1977 Constitution of the USSR), inalienable without the will of the people through a referendum.
- Protected by international law: UN resolutions No. 1803 (XVII) and 3281 (XXIX) on permanent sovereignty over natural resources.
④ The corporate nature of the "RF"
- Since 2023 the "RF" has been re-registered as a State Cooperative Enterprise in the registry of the State Treasury of the USSR, which confirms its status as a commercial structure rather than a state.
- Its attempts to appropriate the assets of the USSR are classified as embezzlement (Art. 93.1 of the Criminal Code of the RSFSR) and international fraud.
⑤ Actions of the GKChP USSR to protect property
- The Military-People's Council (VNS USSR) introduced Resolution No. 3020-1 into the legal system of the "RF" as a normative act, but only to confirm that the rights of the USSR to property remain inviolable.
- Since 2023 all assets of the "RF" have been placed under bankruptcy proceedings, and its affiliated persons bear criminal liability under wartime laws.
Practical conclusions for citizens of the USSR:
- Any transactions with the property of the USSR carried out by the "RF" are unlawful. Demand their annulment through the bodies of the GKChP USSR.
- In your appeals, use references to the 1977 Constitution of the USSR and the documents of the GKChP USSR, ignoring the "laws of the RF."
- Passive recognition of the "property rights of the RF" may be regarded as complicity in the embezzlement of the people's patrimony.
Conclusion:
The property of the USSR is not a commodity, but the heritage of the victorious people. Its inviolability is guaranteed not only by Soviet laws, but also by the norms of international law, which the "RF" grossly violates. Your position must be firm: no compromises with the occupier corporation.
